Have You Been Illegal in Australia? 

Do you want to apply for a partner visa in Australia? The rules about qualifying become exceedingly difficult, but we can assist you. There are important differences if you have been illegal. We can guide you about whether you should apply for the partner visa inside Australia or leave and apply outside. Immigration does NOT easily give partner or spouse visas inside Australia if an applicant has been illegal (i.e. you have no visa).

Your Partner Visa Options

Partner Visa (inside or outside Australia). 

You may qualify for this visa if you are married, de-facto or same-sex partners or spouses. The criteria for the Australian partner visa or spouse visa are the same if you are inside or outside Australia. If you are outside Australia, and especially if you have lived apart for a lot of the time, this partner visa may NOT be suitable.

  • Criteria:

    If you are married or your relationship is registered in Australia, you must show evidence that you have a genuine marriage/de-facto relationship for a minimum of 6 months; longer is better. If you are in a de-facto relationship, you must show at least a 12 months relationship; again, the longer, the better. The evidence needed is crucial to succeeding, and we guide our clients carefully. If you have lived apart for some time, you will need to show further information.

  • Evidence.

    We help you with these as they are crucial to success. Normally, you will need a minimum of 6 months evidence of the relationship, but you will need 12 months to qualify in some cases. We guide you and help you with the statements you and your witnesses will need to write. These are important if you want to succeed.

  • Have you been illegal in Australia?

Prospective Marriage visa (sometimes called fiancé visa). 

You MUST NOT MARRY, and you both must be single or divorced. You must apply outside Australia; this partner visa is not available if you are in Australia. We will guide you on the best partner visa.

  • Criteria:

    You must be able to show you genuinely intend to live together as a married couple after arriving in Australia. You must prove that you have been in a relationship that genuinely appears as an engaged-type relationship for a reasonable period. This is also ideal for arranged marriages.

  • Evidence:

    You must show proof that you are in an engaged-type relationship and that you have made plans to marry.

  • Sponsor:

    The sponsor must be an Australian citizen, Permanent Resident or an eligible New Zealand citizen.  A sponsor must NOT have sponsored someone else for at least 5 years and can only sponsor a maximum of 2 applicants in total. If the sponsor came to Australia on a partner visa, they cannot sponsor another for 5 years. If the sponsor has a police record, it needs special attention. We can help with this. 

Permanent Partner Visas

The permanent partner visas available in Australia are the SC 100 after a 309 Partner visa, SC 801 after a SC 820 and SC 300 visa.

About two years after you lodged your application for the 820 or 309 Temporary partner visa, you will be assessed for an 801 or 100 Permanent partner visa.

A few months before you are assessed, you will receive a letter asking for information to prove you are still in the relationship.

  • What is needed for this visa?

    You must provide evidence that your relationship is continuing. Do NOT take this lightly. The Department has become very tough at this stage, and it is not unknown for them to come to your home unannounced to check if you are truly together. The interviews have also become a lot harder. We guide you through all of these. We have never had this visa refused.

  • What is the cost?

    There is no new visa application fee for the SC 100 or SC 801 Permanent Partner visa as this is incorporated into the SC 820 or SC 309 Permanent Partner visa charges by the Department. The only additional costs will be any professional assistance you get and a new Australian Police check.

  • What happens if the relationship ends?

    An SC 100 or SC 801 permanent partner visa can be granted earlier if either:


    • your sponsor or de facto partner dies, the relationship would have continued if they had not died, and you have developed close business, cultural or personal ties in Australia
    • the relationship breaks down, and there is a child of the relationship
    • the relationship breaks down due to family violence.

    If any of these circumstances occur, you should contact us urgently to advise you about further processing requirements. These can be complicated but will result in a Permanent Partner visa if handled properly.


What Does A Permanent Partner Visa Allow?

If you are granted a permanent visa, you can:

  • stay in Australia indefinitely
  • you are not bound to the sponsor forever. Life can sometimes be difficult, and relationships can end. After getting this visa, you are independent of the sponsor.
  • work and study in Australia
  • apply for Australian citizenship (if you are eligible)
  • sponsor eligible relatives for permanent residence
  • receive some social security payments
  • travel to and from Australia for five years from the date the visa is granted – after that time, you will need another visa to enter Australia.
