Health Waivers - Criteria 4007 and 4005.
Most visas require an applicant to have a medical check before being granted. This is especially important for visas that lead to permanent residency.
If you have a health problem, it may be possible to get the condition approved even though it may be serious. You usually get a chance to get what is called a “waiver”, but it is not easy and must be managed carefully by someone who understands both the process and the health condition.

Character and Police Issues
All applicants for Permanent Residency (PR) Visas and many for Temporary Visas must show they have no significant problems in any country with the police. This is done by getting police clearances from each country where the applicant has lived for a certain period.
The Australian Government can also see if an applicant has a problem in many countries through data matching between countries. They expect you to show them, but they will check as well.

HIV – Client in Australia from Thailand – Criteria 4007 – projected cost assessed by the Department was $112,000. Two children in the marriage, both Australian citizens. The Health Waiver was accepted.
HIV – Client was overseas in Vietnam – Criteria 4007 - one child of the applicant, long term 8 year marriage, the Health Waiver was accepted and the applicants are now in Australia.

Criteria 4005 Health Issues and Visas - Examples
Criteria 4005 cases do NOT have a waiver available.
These are put on different types of visas. A letter from the Department will advise which Criteria you are affected by.
We take a different approach to these. We look for the factors about the applicant, the visa and how these can have a very positive benefit to Australia. An example might be that the field of work is important to Australia, e.g. Nursing, Medical Practitioner, IT specialist, there are many of these. We can then make an approach to the Government Minister in charge of Immigration and request a special exemption from the Criteria 4005 restriction.
